So you are saying that this employee used the composites that were bought from MotionVFX with your wife's credit card? How did he get access to it?

Anyway; I hope you guys can sort it all out to everyones satisfaction.

Mr Austin's latest account of the matter may of course be the whole truth of it, but where I come from the excuse that "the junior employee did it" is usually considered to be on the exact same level as "the dog ate my homework".

Excerpt from an email I sent to FCP.co on Monday:

PS: If the accused do want to back down, all they have to do is say that some imaginary freelancer screwed them by using copyrighted footage without their knowledge

Well I never!

Madnix Tave wrote: Pixel FIlm Studios has come under fire lately from MotionVFX. The shame is it is justified to an extent. We had a employee resign yesterday after feeling an enormous amount of pressure on the things that were done to complete Produst.

Unfortunately young employees sometimes don't realize the things they do and how they can effect the people around them. This employee is great person who just made a bad decision.

I'll echo the comments of others here. Your story may (possibly) be an accurate portrayal of what went down, but the whole thing does smack of "the dog ate my homework". Szymon contacted you on the 8th and posted his blog on the 12th. Are you claiming that during all that time you had no luck in getting your "employee" to fess up? Did you not immediately speak to this employee and ask "Hey, did you by any chance happen to use footage from our direct competitor in the files you produced for us?" Were you lied to by this employee when you (surely) asked this question? It took them until today to finally break down and admit guilt? That's some Jack Bauer type interrogation resistance right there. There appears to be a dog somewhere here that is unable to hunt. And the issue of the use of your wife's credit card to purchase the competing product would need to be adequately explained before you get anywhere near any kind of absolution.

Madnix Tave wrote: This can happen to anyone and unfortunately MotionVFX capitalized on this moment to ruin competition. Mission accomplished? Maybe… However, we have awesome effects and will continue to do so moving forward. We would like to take responsibility as a company for this and apologize to MotionVFX. This is the only time this will ever happen.

You need some work on your mea culpa there, pal. "Capitalized?" "Ruined competition?" Your contrition is getting served up with a side order of sour grapes. Szymon gave you ample time to address this and you replied in a glib manner (including the crack about his command of the English language) and denied culpability before confirming the facts. You apologize, but you poke the guy who you've wronged with a sharp stick along with your apology.

As someone who has taken a copyright infringement case to court before, it is not easy, it is not cheap, it is not short. If you've not gone through the process first hand, you have no clue.

Throwing an employee under the bus to save your own ass is pretty sad. I mean, y'all did purchase the MotionVFX plugin immediately before releasing your own. How does that work?

My full support is behind MotionVFX, I thought the article was well written, and I won't be doing any business with PFS again. My reviews are being pulled.

Interesting idea about pulling the reviews. I'll have to give that some cogitation. My glowing promotion (no pun intended) of Prolumetric, as well as my positive comments on their snow, rain & smoke plugs might have to be reconsidered. Even though Prolumetric is the only one I've purchased so far.

As for the legal ramifications, I've already spent enough time outlining my position. However, having been in numerous legal battles over the years, I do have a considerable clue as to some proper business procedures as they apply to legal matters, thereby still stand by my recommendation to contact your local government trade representatives, in Norway, Poland or wherever Szymon is located. A letter or call from one of his elected or appointed officials could work wonders in a situation like this, all paid for by his taxes & not incurring the exorbitant fees of any sheisty lawyer. How much do people want to wager that half an hour of web searches turns up all kinds of official trade protection offices in his country?

Something about this new site seems familiar: brooklyneffects.com/

Does anyone know who the operators are? The website and associated social media all seems to steer well clear of identifying who is running it. I have my own idea, just wondered if anyone else could confirm?

I definitely think Pixel Film Studios is behind BrooklynEffects.com, everything about it is so similar.

Plus, I received an unsolicited email from "Brooklyn Effects" recently at the same email address I used when I purchased a few effects from Pixel Film Studios (before they were exposed for ripping off other companies' work). That purchase was the only time that I've used this particular email address for anything related to video editing.

It would seem that this is Mr. Austin's attempt to get back on fcp.co after getting Pixel Film Studios banned.

I too received an email from this mysterious entity "BrooklynEffects.com" & likewise am also on the mailing list for PFS. Who, by the way, crank out so many effects per month, one must assume they employ a small army in China.
